ViO Productions Commissioned Music - Terms and Conditions

These Terms and Conditions ("Terms") govern the inclusion of music commissioned from ViO Productions ("ViO") into the ViO Productions DMCA Free Library ("Library") under the Creative Commons Attribution License Policy. By accepting these Terms, you ("Commissioner" or "Purchaser") agree to the following terms and conditions:

Commissioned Music Track Submission:
1.1. The Commissioner grants ViO the non-exclusive right to add the commissioned music track ("Track") to the Library after its creation.
1.2. The Track shall be an original composition produced by ViO, and ViO shall have full legal rights to grant the permissions outlined in these Terms.
1.3. The Commissioner shall ensure that the Track complies with all applicable laws and regulations, including copyright laws and intellectual property rights.

Creative Commons Attribution License:
2.1. The Track shall be licensed under the Creative Commons Attribution 4.0 International License ("CC BY 4.0").
2.2. Under this license, ViO is free to share, adapt, and distribute the Track, even for commercial purposes, as long as proper attribution is provided to the Commissioner.
2.3. Proper attribution includes featuring the Commissioner's or Purchaser's name or username on the Track in all reproductions and distributions.

DMCA Free Library:
3.1. The Library is a collection of music tracks that are DMCA-free, allowing users to use the Tracks in their creative projects without the risk of copyright claims.
3.2. By adding the Track to the Library, the Commissioner acknowledges that the Track will be made available to the public under the CC BY 4.0 license.

Rights and Ownership:
4.1. ViO shall retain all rights and ownership to the musical composition and sound recording of the Track.
4.2. The Commissioner shall have the right to use the Track for personal, non-commercial purposes without any additional fees or restrictions.

Credit and Attribution:
5.1. ViO agrees to credit the Commissioner as the purchaser of the commissioned Track by featuring the Commissioner's name or username on the Track in the Library.
5.2. The Commissioner agrees that ViO may use the Commissioner's name or username in promotional materials related to the Library.

Warranty and Indemnity:
6.1. ViO represents and warrants that it has the necessary rights, licenses, and permissions to produce and license the Track to the Commissioner.
6.2. The Commissioner agrees to indemnify and hold ViO harmless from any claims, damages, or liabilities arising from the Track's use in connection with the Library.

Termination:
7.1. Either party may terminate this agreement by providing written notice to the other party.
7.2. Upon termination, ViO will remove the Track from the Library within a reasonable time frame.

Governing Law:
8.1. These Terms shall be governed by and construed in accordance with the laws of [Your jurisdiction], without regard to its conflict of law principles.

By accepting these Terms and allowing the inclusion of the commissioned Track in the ViO Productions DMCA Free Library, the Commissioner acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. If the Commissioner is acting on behalf of an entity or organization, they represent that they have the authority to enter into this agreement on behalf of that entity or organization.
